BR toddler dies after accidental shooting

A Baton Rouge man who authorities said was playing with a gun was booked with negligent homicide Tuesday in the accidental shooting death of his 2-year-old brother.

Terrance J. Varise, 18, 5108 Jean St., was playing with a .357-caliber handgun at 6:30 p.m. Monday when his younger brother Travin Varise walked into the room and was struck in the chest, police and family members said.

The boy was rushed to a hospital where he died Tuesday morning, police spokesman Cpl. L’Jean McKneely said.

Terrance Varise admitted to detectives “that he was carelessly playing with the gun when it accidentally discharged,” according to an affidavit of probable cause.

“He had it in his hand, cocking it back and forth,” McKneely said, adding Terrance Varise had been upset about the shooting.

“The entire family was upset,” McKneely said. “They know it’s an accident. It wasn’t intentional.”

Terrance Varise’s uncle Calvin Varise said he had just left the Jean Street home Monday evening when he learned of the shooting via text message.

Calvin Varise said the family had not kept a gun in the home, adding he believes Terrance Varise got the weapon from a friend.

He said the teen had armed himself due to “environmental pressure” from neighborhood friends, whom he described as “roustabouts.”

“They’re just floating and they have no anchor to hold them down,” Calvin Varise said. “We’ve lost two.”

Terrance Varise was booked into the East Baton Rouge Parish Prison on counts of negligent homicide, cruelty to a juvenile and felon in possession of a firearm. He was being held Tuesday afternoon without bond, prison officials said.

Court records show Terrance Varise had been on probation for a 2011 simple burglary of a motor vehicle in Iberville Parish. He pleaded guilty to the charge in May and received two years probation and a suspended two-year prison term, the records show.

Terrance Varise indicated on his Facebook page that he had an affinity for “shooting games” and Grand Theft Auto IV, a popular video game. One photograph shows him with his eyes closed, holding a revolver at his side.

Police declined to say whether the weapon in the photograph was the same used in the accidental shooting.

Calvin Varise said the family had not objected to the counts against his nephew.

“God is just,” he said, “and he’s going to deal with it according to his structure.”

The mother of the victim, Yenell Varise, was too distraught to speak to reporters Tuesday.

Calvin Varise said he will remember Travin as an energetic boy who loved playing outdoors and watching “Finding Nemo.”

“He had a smile,” he said. “He was a beautiful little kid. He mimicked me like my son. I loved him to death.

“Guns are not to be played with. Now we’ve got to figure out a way to bury the little man. You wouldn’t expect a little infant to die.”

Travin’s death marked the second accidental fatal shooting in Baton Rouge in three days.

A rifle accidentally discharged early Saturday morning killing an 18-year-old Denham Springs man while he was at a house on Main Street, McKneely has said. Trevon Wilson, 8639 Forrest Delatte Road, Denham Springs, died at a hospital from a single gunshot wound to the chest.

No one has been arrested in that shooting, police spokesman Lt. Don Kelly said Tuesday.

On Dec. 29, deputies in Ascension Parish arrested a 14-year-old boy accused of accidentally shooting 13-year-old Christian Crain in the head while playing with a stolen .38 special revolver with two other teenagers in the bedroom of a Prairieville trailer.

Nimby the first news report I heard immediately after stated the shooter was found inside the school with 2 semi-automatic pistols by his side and an " ASSAULT RIFLE " was found in the trunk of his mother's car parked outside.

Why not? because that would cut into some yahoo's perceived right to have an arsenal and might cut into gun dealers' profits by actually making them accountable for selling weapons of mass destruction with little regard for public safety? I miss anything? Oh and by the way, I don't want the government to seize any guns already legally acquired. It doesn't matter how many laws we make to try to control illegal activity if there is no true punishment for the crime. Crimminals are not afraid of a little jail time. Host, drugs are intoxicants, used on oneself. Guns are weapons, which are used on others (and oneself). Still confused? You see... you use different standards when comparing 2 different things. And in case you didn't notice.... there already is an illegal gun market and the vast majority of those guns are made right here in the U.S. in a legal factory, not like moonshine out in the woods or like meth in a trailer in Denham Springs or cocaine in a bunker in Columbia. "Enforce the laws already on the books" they say. Yeah, that'd be great....except for one thing. We can't. There are 2,500 ATF inspectors for about 200x as many gun dealers (which doesn't include "private" sales). Dealers are not required to take inventory. Dealers are not required to report sales. Dealers are not required to cooperate with the police or FBI. Dealers are not required to turn in background checks (they're destroyed after 24 hours). They're not required to report when someone fails a background check. With private dealers, they're not required to do background checks at all. It's illegal for the ATF to keep a national database using computers. Yeah. If only the restrictions to selling guns were half as strict as the restrictions placed on the law enforcement agency that is supposed to "enforce the laws already on the books." And I'm the naive one? You must be joking. And you say that most gun owners are law abiding citizens. Ok... so if the tax was high enough, these people would throw the rule of law out the window and buy guns illegally, just so they can get them cheaper? Interesting. Also... all of this ***** ignores the question: where did this guy get a gun? He's a felon. Where'd he get it? mcarter: I love how you relate the suspension/dismissal of students in the public schools to this issue. Just for example, EBR is in Corrective Action with the state department because they suspend/expel too much students (with special needs). What can a poor teacher/administrator do to a child who have been 'consistently' having behavioral problems? Actually, if a school suspend 'too much' kids, it could be a ground for administrator's removal. What is America's answer? Positive Behavior Support. When you hear the title, you know that it is a lot more teacher's paper work than child's intervention. It could work in a rural school, but 'high needs' school needs additional help.

Yes DMJ is that naive about things when it comes to guns. He can understand the login when it comes to the war on drugs but somehow his logic fails him when it comes to guns. They would be one in the same if both are made illegal. Drugs being illegal isn't stopping anyone from using and obtaining them all they want and I think DMJ would acknowledge that fact. He is just incapable of seeing that the very same issues would come about from making guns illegal. So long as people want a good someone will find a way to provide it. Even those that we pay to stop said illegal items are well known for selling them because the only thing outlawing a good does is create a black market for them and we all know this as a fact that is not even up for debate. Even a highly excessive tax rate on legal goods can create a black market. IE Cigarettes... This was a thug with an illegal gun in his hand, period.

I really love the magazine restrictions and bans these shallow minded obamacrats are proposing. Some are saying limit them to 7,10, or whatever. Let's use 10 for now.I could own a gun capable of only holding 10 rounds and would be legal. Putting one more round in the magazine would be illegal. However I could have 4 more 10 round magazines in my pocket and would be capable of firing 50 rounds by changing magazines which can be done in 2-3 seconds max. Another point : I could walk into a crowded room carrying a shotgun loaded with 5 shells of buckshot ( which is legal except when hunting then 3 is the limit ) and in those 5 shots ( without having to take time to aim ) drop more people than you could with a so called " BUSHMASTER AR-15 ASSAULT WEAPON " with a " HIGH CAPACITY MAGAZINE " and in a lot less time.

If it were up to me I would build enough prisons to put this type of human debris away in the most inhospitable of conditions. Our justice system must begin to demand that those who pass judgement on these criminals are forced to sentence them to prison time. I understand that the gun used in this tragedy spoke to Terrance and convinced him that he should be playing with it, so it really wasn't his fault...it was the guns fault..I think we should sentence that specific gun to probation, community service, and a firearm safety course...yeh that will show it.

My question to you is this, If all the restrictions and laws to limit ownership of guns, limit magazine capacity, and the other things you listed in your post below, would that have prevented this tragedy? I don't think so. This is a great example of why gun control is a joke. People have the right to protect themselves and their property. Criminals will have guns, and have no regard for the law, or you, or your property. It is a shame this innocent child got killed, but if it had not been him, I guarantee it would have been someone else. This criminal would have used this gun on someone else.

MissCotillion, I think you have hit on the main problem. Slap on the wrist judges and plea bargaining. Oh, but, we incarcerate too many thugs already and don't have jail space. It would just cause Louisiana to have high numbers that make the state look bad and backward to the bleeding heart liberals. They won't try in school, so they want to be thugs. They have no fear of consequences. The lax sentencing and the picture above is typical of why people want more intense protection. If there were more jails and stricter judges maybe there would be less guns on both sides. It's a question of what you prefer, the highest rates of gun violence and deaths or adequate jails.

nimby, I've rarely ever heard anyone want to ban all guns. Ban assault weapons yes, not all guns. There is no "one solution" to this problem as it is a combination of things. I prefer not to keep a gun in the house because I believe an unintentional shooting is very much more likely than a self-defense one. Unfortunately when I leave the house, I have irresponsible parents and gun owners, including those who were purchased illegally to have to deal with. Whose rights are being infringed? If I go grow 2 dozen pot plants in the backyard, uncle sam will confiscate them, right. Why ? In the name of public safety? The double standard and ignorance that is so pervasive in this argument is scary.

The solution to these incidents will end up being compulsory conscription to a branch of the armed services for a minimum of two years for EVERYONE when they either leave high school early without graduatiing, graduate high school, or leave a university. Get the education out of the way and then serve at least two years in the Army or any branch of the armed forces. That will teach morals, values, respect, discipline, honor, and give people the character they need to make something of themselves they will be proud of. It wouldn't be fool proof but it would put an end to a lot of this violence of stupidity.

I simply want the ATF to be able to track gun sales. I want all sales to be documented- no more loopholes. I want background checks for all sales. I want gun dealers to be REQUIRED to cooperate with law enforcement during investigations. I want dealers to turn in their background checks to the ATF instead of destroying them after 24 hours. I want a federal registry. I wanted mandated inventory checks. I want a giant excise tax that disincentivizes gun/ammo sales and funds law enforcement. I want voluntary buyback programs of certain types of guns. I want an assault weapons ban and a ban of magazines holding more than 10 rounds. Did you see confiscation anywhere in there?? You're usually smarter than the yahoos that post on these boards. Why not with this issue? So, let me get this straight.... in order for any shooting to be a gun issue, the gun would have to fire itself? That's dumb. Clearly, this is a gun matter, as are all shootings. You can't have shootings without guns, after all. Yes, there are more variables at play, but the common denominator in ALL shootings are guns. Please, remember this story next time you're weighing the net positives of guns vs. the net negatives. BTW, this was not the only accidental shooting in the area over the weekend....there were also several other regular intentional shootings. First, my condolences to the family of this little one. I can't imagine the anguish they are experiencing. This, however, is not the fault of the gun. It is the fault of the felon that obviously had never been trained in the safe handling of a firearm. Another thing, where was the father of this family? No amount of gun control laws will ever prevent cases such as these. The felon was committing another felony, possessing a gun! Yes, this was accidental in a way, but it was not in another way. A gun being handled in the way described and for the reasons described indicate to me that this was not simply an accident. Lots of things were intentionally done wrong here by the older brother, some neighbors, and possibly by the mother (allowing the gun play, maybe she did not, can't tell from the article but it appears at least possible). We have a lot of work to do to reverse this situation. We can do it. I do feel sorry for all and hope they can get some peace going forward. It will be hard. I cannot really imagine. One part of getting some peace will be facing the facts that led to this tragedy.

Len: Newsflash for you since you are obviously blind and lack any amount of logic. GUNS that you claim nothing good ever comes from have given you every last right you enjoy as an American. I guess guns defeating the Nazi's was a bad thing? That woman that shot that guy last week after breaking into her home with her kids went badly because the guy got shot. Whereas in your mind I imagine had the CRIMINAL had unarmed victims and murdered them you would be just fine with that? I see more deaths by car accidents on the news and people just trying to cross the streets in BR than I do accidental gun shootings. Please point me to you right to a car or even a horse and buggy under the Bill of Rights! This gun did not kill this kid his BROTHER DID. Felon at 18 already continuing on with more felony acts like possessing a GUN! Once again the criminals prove that the laws don't matter to them. If they did they wouldn't be criminals to begin with now would they? This kid was destined to kill someone eventually he just managed to make it his little brother instead of someone else's!

Yes, banning me and other law abiding citizens form having guns would have prevented this tragedy. No doubt about that. This FELON would have never been holding a gun in the first place since he could not have legally gone to a gun shop to purchase one. Stupid us. @DMJ: He was a criminal. Laws were already in place to prevent him from possessing a firearm. The laws didn't stop this tragedy because criminals, by definition, disregard laws. Everyone must know this on an intellectual level. Those that do not accept this truth think emotionally, not intellectually.
