'I's here' roll-call reply judged not malicious 

Two members of the Louisiana Auctioneers Licensing Board did not act maliciously toward a former board member, who is black, by answering the roll call “I’s here” and “I’s here, too,” according to a report from the Office of the State Inspector General.

The former board member, the Rev. Freddie Phillips, filed a complaint in December, the report says. Phillips alleged that at the board’s Nov. 5 meeting, board Vice Chairman James Sims and board member Gregory Bordelon answered the roll the way they did to intentionally offend Phillips.

“However, our investigation found no evidence to support the allegation of malicious intent directed at Rev. Phillips or anyone else,” Inspector General Stephen Street said in a Feb. 22 letter to Gov. Bobby Jindal.

Sims told investigators he is a diabetic and has dentures, which sometimes cause him to speak unclearly, Street said in the letter.

“He (Sims) stated ‘Sometimes things come out wrong,’ ” the report says.

Sims also repeatedly used “I’s” during the interview and it appeared to be “an unintentional part of his dialect,” the letter says.

Bordelon had denied saying “I’s here, too,” in an interview with The Advocate.

In his letter, Street said Sims’ and Bordelon’s responses are clear in the audio recording of the meeting.

And under questioning by the Inspector General’s Office, Bordelon said he intentionally answered “I’s here, too” during the roll call because he was responding to Sims’ reply, Street said in the letter.

Bordelon described Sims as a “north Louisiana redneck,” the letter says. And Bordelon described saying “I’s here, too” as “a friendly mocking” of Sims’ speech.

Phillips rejected the explanations for the responses and the report’s conclusions.

Phillips said he has missed only one Auctioneers Board meeting in the last four years, the Nov. 5 meeting. In all that time, Phillips said, Sims never used the phrase “I’s here.”

More recently, Phillips and former Louisiana Auctioneers Licensing Board board member Robert Burns filed a lawsuit Wednesday in 19th Judicial District Court asking that the board, Sims, Bordelon and board chair Tessa Steinkamp pay damages for violating the state’s Open Meetings Law.

The lawsuit says Sims, Bordelon and Steinkamp refused to let Phillips and Burns, members of the public, speak on agenda items at the board’s Jan. 8 meeting, a meeting in which the Nov. 5 minutes were on the agenda for ratification.

Phillips asked to speak about the minutes of the Nov. 5 meeting, which Phillips said should show Sims’ and Bordelon’s exact responses to the roll call, the lawsuit says.

However, at the January meeting, board attorney Larry Bankston said Phillips would not be allowed to comment on the content of the minutes, according to the lawsuit.

The lawsuit says Burns also was denied the opportunity to comment on an agenda item.

The lawsuit says the state’s Open Meetings law requires public bodies to allow the public to comment on any agenda item requiring a vote.

Bankston said Thursday he could not comment on the lawsuit because he hadn’t seen it.

Meanwhile, in his letter to the governor, Street said interviews with other board members revealed that no one present found the comments offensive.

Board members also said no members of the public attended the meeting, which board members described as loose and relaxed, Street said in the letter.

The laughter heard on the recording after Bordelon’s response was a reaction to Bordelon repeating Sims’ response, Street said in the letter. All the board members said the roll call replies were not intended to offend Phillips.

“Given the above, we are closing our file and taking no further action in this matter,” Street said in the letter.

They called themselves rednecks. Rednecks are racist. Using dialect to mock is clearly a racist act. The definition of racism includes malicious. Therefore the comment, whether it was specific to the particular black person it was racially disrespectful just as if they had used a racial slur.

Whatchange: Twinkie1cat used "redneck" because that's a direct quote of one Board Member, Bordelon, describing another, Sims. By your statement, we may now assume Bordelon was calling Sims racist, correct? I don't suppose you quit reading after the first paragraph, huh?

Great observation, Jeff!! Anyone who may be interested can watch LALB videos going back to September, 2010 at www.auctioneer-la.org/videos.htm. You'll never one time hear Sims say "I's," so yes, hhis interview strategy was nothinig short of brilliant!! As Chucky says, in watching the videos, you can wonder whether to laugh or cry. Thanks for the link you provided too, Jeff. Obviously, you've been following this saga in detail. Good luck on getting the public records you've been seeking so long. Wouldn't have figured appreciation was in order for a "mere" one-month timeframe!!

Suffice to say, the IG couldn't rule anything but this as long as the flimsiest excuses were given. Got to love Sims' tactic of intentionally altering his speech for the IG interviews -- his IQ must be nearly 100 in order to have thought that up.

LawyerDan65: That's exactly the Statute cited in the lawsuit, LA R. R. 42:14(D). Will be interesting to see how Mr. Bankston, acting on behalf of three of the Board Members (two were not named as defendants because they opposed the censorship) , defends his action of refusing to allow public comment regarding the 11/5/12 minutes. During the meeting, he said it would be "inappropriate," yet he apparently found nothing "inappropriate" at the time the roll call transpired. Whatnow: The IG's Office had the website link, www.auctioneer-la.org. While it is a collection of past episodes of insults to Gov.. Jindal and Phillips and provides no direct evidence of malicious intent at the 11/05/12 meeting, the pattern is pretty clear!! People can judge the Board from its own actions and words depicted on that webpage, but I vote "utter embarrassment " and agree with your recommended action of total wipeout.

"I is" (or the contracted form "I's") is characteristic of some, but not all, speakers of African American Vernacular English. Despite what you might see on the "Beverly Hillbillies," Caucasians do NOT use that construction in their dialects......unless they are trying to be derisive toward black people. I suppose ignorant rednecks think the rest of the world is as ignorant about language as they are.

LRS 42:14 provides in pertinent part: ...each public body conducting a meeting which is subject to the notice requirements of R.S. 42:19(A) shall allow a public comment period at any point in the meeting prior to action on an agenda item upon which a vote is to be taken... This includes votes on approving the minutes.

What an insult to Mr. Phillips! The racism is blatantly found in these tapes with the "I's here" remarks. How this could be NOT malicious intent, I do not know what is. Evidently the Inspector General doesn't know what it is either. These ignorant people should all be thrown off that board.

I am assuming the accused party is or at one time was gainfully employed as an auctioneer. How do you perform your duties as an auctioneer if you have a serious problem pronouncing words. I have met a lot of diabetics over the years through my job. I don't recall any of them having a speech problem associated with the disease. Ditto for people with dentures. I would surmise that if someone engaged Mr Sims in an argument of any kind, his speech difficulties would be smote by a miraculous healing that would impress even Jesus.

Dday198: Did you go to the webpage? If not, just do so and watch the second video beginning at the 5:57 mark (as outlined on the webpage). Nah, there's certainly no malicious intent there on Sims' part (just the "diabetes and dentures, I'm sure). Just watch the video where Phillips is asked 4 times if he's carrying a weapon (last video). Just go see where Phillips is threatened repeatedly with lawsuits just for questioning a payment that was totally unauthorized by that Board (3rd video starting at 3:09 mark). Nah, these people couldn't possibly have malicious intent toward Phillips. It's all just those darn "dentures and diabetes flare ups!"

Anyone going to that website, www.auctioneer-la.org can merely listen to the very first audio file. In it, Vice Chairman James Sims lambasts Gov. Bobby Jindal. Oh, I forgot.....that was his "diabetes and dentures" flaring up again (this time for about a full minute!!!). What an absolute joke of a State Board!! Gov. Jindal, is this REALLY the best you can do?????????
