White’s appeal calls firing ‘null’

Ex-chief says his rights were violated

Fired Police Chief Dewayne White on Thursday requested an expedited hearing before the local civil service board, claiming his termination should be overturned because city-parish officials violated his protections under the police officer’s bill of rights.

The appeal, filed with the Municipal Fire and Police Civil Service Board, asserts White’s firing is invalid on its face due to a series of missteps city-parish officials made this month, from the manner in which White learned of his impending termination to the format of his disciplinary hearing before Mayor-President Kip Holden.

“If you don’t follow the police officer bill of rights to the letter, then the law says that whatever you’ve done is null and void,” said Jill Craft, White’s attorney. “That’s why we’ve asked for expedited consideration.”

Holden fired White Monday after accusing him of insubordination and repeatedly violating departmental policy. The termination followed months of mounting tension between White and the local police union.

Murphy J. Foster III, Holden’s attorney in the proceedings, said White’s appeal is “factually inaccurate” and “misstates the law.”

City-parish officials have maintained White is not entitled to a civil service appeal because he is not a classified employee under the local Plan of Government, which states, in Section 9.05, that the unclassified service includes “heads of departments appointed by the Mayor-President.”

However, state law — R.S. 33:2481 — says police chiefs are included in the classified service.

Foster said Thursday that city-parish officials have decided not to seek a court order to block White’s civil service hearing. But he said the city-parish reserves its right to challenge the board’s jurisdiction in later court proceedings.

The five-member civil service board could reinstate White with a majority vote.

“We will respond to the appeal and we will show and produce witnesses and evidence at the civil service board hearing to set the record straight,” Foster said.

The timing of White’s civil service hearing remains uncertain. The earliest a hearing could take place would be next month, but the board’s chairman, Sgt. Bryan Taylor, said it could be April or May depending on scheduling.

Taylor said late Thursday that he plans to contact Craft and Foster early next week to discuss a hearing date. The board meets only once a month, but Taylor said a special meeting could be called to hear White’s appeal.

White’s appeal alleges several violations of R.S. 40:2531, a state statute known as the law enforcement officer’s bill of rights. Craft claims White was never informed, prior to his Feb. 6 meeting with William Daniel, Holden’s chief administrative officer, that he was under investigation, as required by law.

White’s attorney also claims the Feb. 6 meeting should have been recorded. Daniel has said he did not record his Feb. 6 meeting with White, and the city-parish, in response to a public records request, also said no recording exists.

Craft also contends White was denied his right to have an attorney present during his meeting with Daniel. She claims officials also failed to notify White of complaints the police union made against him during his nearly two-year tenure.

The appeal takes aim at a Feb. 13 letter Holden sent to White outlining 14 reasons for his dismissal, including claims that he showed favoritism to a hire, made improper transfers and shredded documents. The letter makes “unconstitutionally vague allegations” that lack dates, times, places and witness information, White claims in his appeal.

“Appellant is entitled to and desires immediate reinstatement to his position with full back pay, emoluments and benefits of his office, together with attorney’s fees as allowed by law,” the appeal states.

The appeal cites a part of the statute that says discipline against a law enforcement officer “without complete compliance with the foregoing minimum standards is an absolute nullity.”

White, fire your attorney. IF she indeed told you to huff and puff and make a dramatic exit after your testimony. We only want to see that from our little girls when we tell them we don't like the guy she wants to date NOT from our Police Chief. NO dramatic exits! Ever. Next time, stay in your seat, fold your arms across your chest (if you must) and stare down you opposition. One can appear too sensitive. A snicker would have been better than a turn on your heels.

This goes on everyday in the workforce, but most employees can't afford high price lawyers to come to their aid. I have mixed emotions and thoughts on this case. If it is found that Mr. White is not a civil service employee, his firing should be upheld by the court because that would make him an at will employee. His attorney likes to take cases that only puts her in front of the camera. This happens everyday to regular employees and no one cares. Judges find ways to side with the employer, so I'm curious to see if this is thrown out on summary judgment.

Everybody involved in this incident has behaved badly and the mayor, who was elected by the people should be held to a higher standard. I have been concerned since his disagreeable behavior with the Federal grant and the Sheriff. The Mayor has not been acting like a responsible adult. It would sem that the Mayor has lot a lot of voter support.

Everyone involved in this has behaved badly. The reason I took exception to the LTTE about police seemingly overreacting at a parade when one of "their own" was assaulted is because whether you realize it or not, the Police are the only thing standing in the way of full blown civil disobedience and anarchy. Anyone appointed to lead a Police Department should have exhibited behavior above reproach or do not expect the same from your Force or your Unions. White let his emotions interfere with his judgements and he will tell you so - eventually. Why? Because we all do it. It's called being helplessly Human. Holden did the same. As did Stewart. Children, all. Men and women who aspire to lead should have better control over their emotions. NOW, go to bed.

PS, to clarify my last comment below: I just don't like the sound of the Union becoming spiteful and calling the mayor (needs check and balance). Reminds me of Katrina destroying the Superdome which was resolved by issuing tens of millions in traffic tickets and installing traffic cameras (needs check and balance, not kosher); as the money should have come from Fed disaster assistance (printing press).

Maybe Mayor Holden should cut himself loose from his advisers, admit he made a mistake, and hope the people in BR get over this in a big hurry. Then Mr. White can make the decision of whether he wants to stick around or not. under the existing circumstances. Just my opinion, of course.

Not only will Kip Holden not admit he was wrong, but when this all hits the courts and its reversed, Kip will come out and blame his CAO, which is why he referred to this as 'going with my CAO's recommendation of terminating the chief'... the only thing he will ever admit he's wrong about is not having a 4th round before dropping off his girlfriend and going home to his wife.

I believe that Kip Holden overstepped his authority in this case. It would take a real man to stand up and admit a mistake, and nullify Mr. White's termination, and reinstate him as Police Chief. In this way Mr. Holden might re-establish himself in a positive way with his constituents.

Have anyone of you given one thought to this man's career that was virtually destroyed. Destroyed for the explicit purpose of Holden's reelection. I dare say if any of you making statements as to him reminding you of a child were in the same situation, you would be squealing like a stuck pig. White had the job level of major with the LSP. He had 30 years police experience. Now I'm sure he did not become a major with the state police having no credentials or expertise. He worked for BRPD in the past and with support from Kip he would have made some much needed changes. People who have no common sense can make some very unwise and ignorant statements.

All joking aside. White and Holden remind me of two little boys holding their breath and nursing their grudge against one another without much thought about anyone else. Elect the next Chief or appoint an experienced negotiator who has a solid confidence about himself and who understands one absolutely cannot stop a fight with a fight. White must go. Next, Kip must go. Children belong in school or in bed or grandma's house. And don't go worrying about Steward. He's gone too. After all this blows over, a new Union Head will be put in place and everyone knows it. Just sit back and watch the saga unfold. Now go to bed.

This court case isn't just about Chief White, it's about all the citizens of Baton Rouge. If he isn't stopped Baton Rouge will just get worse. We need to all realize that "Kipoleon" thinks he has to follow no laws or wants to interpret them to suit his needs/wants. I am hoping that this court case will show our mayor that he cannot run Baton Rouge like a dictatorship or act like a baby when he doesn't get his way. I remember the bridges he closed after his last tax for "Kipland" didn't pass. I still do not see how he got re-elected, but maybe the people who voted him in will see what kind of person he really is.

Easy Company and Duckyluve, you do both realize that White hasn't produced any credible evidence because there hasn't yet been a single reason to do so? Not sure if you understand exactly what Monday was all about (though its obvious neither of you do), but it was a simple forum, of which was not presided over by a judge, where White got a chance to rebut the letter written by Holden's cronies. What you are implying is that White should have produced evidence and witnesses at something that wasn't a court hearing. I'm pretty sure that you two realize 'witnesses' and 'evidence' are both terms that imply there's a trial or some sort of legal proceeding taking place. I'm also quite sure you both realize that you never show your hand too early in a poker game. Speaking of evidence or witnesses, I must have missed all of Holden's evidence and witnesses and I was in the crowd at the hearing. Also, while we're on the subject of 'man to man' speaking and acting cowardly, enlighten me on why the gentleman that issued the letter of (non)termination to White and suggested that Holden terminate him, didn't say a single word? I'm sure you know who i'm speaking of. He was sitting to Holden's right and the look on his face was that of a deer in the headlights as he stared aimlessly into the crowd. He's the guy without a days worth of law enforcement experience that was making personnel decisions at your Baton Rouge Police Dept. He's the guy that didn't give White the option to have an attorney present when he presented to him his letter of immediate termination, which was only a letter stating that he was on leave, something that he is legally obligated to do, but I wouldn't expect him to know that. Lastly, if White is such a bad guy and so awful at his job perhaps we should take a look at the guy who hired such a bad seed and see to it that, given his incredible lack of good judgment when it comes to hiring new employees, he's not permitted to do so anymore. Just a thought.

This guy (Dewayne White) is impressive in the worst qualities imagineable. I am not nearly as naive as the vast majority of public opinion on this topic. Since being terminated he's made allegations with little evidence, dodged direct questioning, and failed to produce any credible witnesses. I hope the Civil Service hearing he so desperately seeks is granted and gives us all some clarity. However, I suspect his attorney is only going to do what trial lawyers do and cloud the proceeding with litigation about procedural errors during the sequence of termination.

duckyluve - I would guess that what Mr White wants accomplish is to leave (if he has to) with his pride and dignity, and he wants to prove that he was correct in the decisions he made and that he told the truth. I will say that whether he is right or wrong, I respect Mr. White for sticking this out instead of just leaving BR and saying nothing. Besides, clearing himself from these charges will probably also make it much easier for him to find another job in another city if necessary. Of course, that is just my opinion. Besides, some of us older folks still believe that when you die you will not be judged on how much money you made but how you actually lived your life.
