District Attorney Hillar Moore III said there were not enough votes by the grand jury to charge Dennaryo Lathers, 20, in Jackson’s killing. Lathers, 2245 Cunard Ave., Baton Rouge, was booked April 17 on one count of first-degree murder, three counts of attempted first-degree murder and illegal use of a weapon. Jackson, 27, 2326 Rhodes Ave., Baton Rouge, was shot multiple times in the upper torso with a handgun while sitting in the front passenger seat of a vehicle about 2 a.m. June 9 outside the club, 3964 Plank Road. The shooting followed an argument inside the club. A friend of Jackson’s drove her to Baton Rouge General Medical Center hospital, but she was pronounced dead on arrival. A second victim was shot but survived. Octavia Jackson’s mother, Gilda Jackson, has said her daughter was at the club celebrating a cousin’s birthday with other family members. Prosecutors can bring the case back before a grand jury at a later date, Moore said.
