Coach sues in handcuffing

Incident occurred during football game in Bossier City

Live Oak High School’s football coach —who was handcuffed but not arrested while his team was warming up before its Nov. 9 playoff game with Parkway High School in Bossier City — filed suit Wednesday claiming he was unlawfully detained and defamed over a marching band dispute.

Television footage of Barry “Tut” Musemeche being led off the field in handcuffs was broadcast around the state and throughout the South, according to the lawsuit filed in state district court in Baton Rouge.

Musemeche was released and did coach the Eagles in a 36-13 loss to the Panthers.

“It’s totally unfortunate that an event like this happened. I feel what happened was outrageous,” Musemeche said Wednesday.

His suit claims Live Oak’s band was originally scheduled to perform from 6:35 p.m. to 6:45 p.m., and when the band opted not to perform, Musemeche was told by Parkway coach David Feaster that the Live Oak team could warm-up until the Parkway band was scheduled to perform at 6:45 p.m. The head game official also agreed to allow the warm-up, Musemeche said.

But at 6:35 p.m., Musemeche heard a public address announcement saying Live Oak’s team had to leave the field, the suit says.

Shortly after the announcement, a Bossier City police officer and Parkway Principal Nichole Bourgeois approached Musemeche and demanded that he leave the field immediately. Musemeche told them about the agreement with Feaster and the head game official and that his team would be off the field by 6:45 p.m., the suit says.

“Nonetheless, suddenly and without warning, Bourgeois told the officer, ‘cuff him, get him off the field, cuff him,’ ” the suit says.

Musemeche was handcuffed and escorted to the outside of the locker room area, where he was re-cuffed, causing injuries to his arms, including bleeding, cuts, bruising and numbness, the suit says.

Musemeche did not resist being removed from the field, the suit says.

“My team was warming up 20 to 25 minutes before the game. You see that at schools every week. It was outrageous and unnecessary for a coach to be put into handcuffs in a situation like that,” Musemeche said.

Bourgeois repeatedly asked Musemeche during his detention, “So now you are going to respect my authority?’’ the suit says.

Bourgeois, the Bossier Parish school system and the Bossier City Police Department are named as defendants in the suit.

The suit says there was “no basis” for Musemeche’s detention.

The Bossier Parish School Board and Parkway were closed Wednesday for the Thanksgiving holiday and could not be reached for comment. Bossier City Police Chief Shane McWilliams was out of the office and unavailable for comment.

Musemeche is suing the Bossier school system and Bourgeois for libel, slander and defamation.

Bourgeois said after the game in a broadcast report that the Live Oak team refused to leave the field so the Parkway band could perform.

“From my client’s perspective there are two objectives. The first is to clear his name,” Jill Craft, who represents Musemeche, said. “The second is to stand up for all the teams and athletes out there.”

Craft said she has “never had a case like this one.”

Louisiana High School Athletic Association Executive Director Kenny Henderson said a sportsmanship hearing is tentatively set for 10 a.m. Nov. 29 at the LHSAA office in Baton Rouge.

The LHSAA required both schools to submit reports on the incident.

The suit, which seeks damages, has been assigned to state District Judge William Morvant.

Live Oak High School is located in Watson in Livingston Parish.

This is a public forum and last time I checked I was entitled to my thoughts...I never said I was the authority of Live Oak, Walker, Baton Rouge, or Bossier. FYI honey, I have lived in Baton Rouge for the last 12 years, but I guess the fact that I can live here and work and my child live somewhere else is totally foreign to you. Keep it in Bossier, honey. Your made-up comments aren't wanted in Baton Rouge. Ask the Musemeche's. They've always lived in Baton Rouge - which you would know if any part of what you had written were true. By the way, his lawyer goes "ka-ching" every time you get on here. For the record, since you are in Bossier and don't know, Live Oak is not in Walker, either. What now? You've decided you know him? Add some more! C'mon. Ka-ching!

LOL...ya'll are really taking your conspiracy theory too far. It's HIGH SCHOOL football. Just because I live in Baton Rouge, for employment reasons and my child lives in Bossier for educational reasons is not too far-fetched. As far as speaking with coaches in the area...well I am an educator sooooo there goes that theory. Just because people say he is this and that should I just believe you? After all you are some nameless, faceless person as am I. Now birds of a feather flock together, so maybe it's not a problem for you that someone that should be a role model would use racial slurs because you have the same opinions. Like I said, it doesn't bother me because you are entitled to your opinions and your thoughts. Well I guess Bossier is just like WALKER cause I've heard and seen pictures that the KKK is very active in Walker. I really don't care if you believe me or not...my being is not wrapped into HIGH SCHOOL FOOTBALL or this conversation....but either way...it will be sorted out behind closed doors like nimby said.

I agree with you, redavaw1. Both of my sons have played for Coach Musemeche and he is an excellent coach. I have never seen him be anything but professional. It is a sad state we are in when faceless, nameless people can attempt to ruin someone's reputation with false statements. I support you, Coach. I hope you take them all to the cleaners!

Not only do you have a child currently attending Parkway then you add that you live in Baton Rouge now you add that you have personally spoken to other football coaches in Baton Rouge all the while you are female with no sports connections? Read the other comments here by people that KNOW this coach. Try to sell the racial slurs theory in Bossier. I hear that type of thing is common there.

LOL...FootballMom you are hilarious...How do you know that he, the coaching staff or the players did not call the Parkway players, fans, etc racial slurs? Were you there? I don't know about looking silly, seeing as how you are getting all worked up about something as asinine as HS Football. I just know that everybody can't be lying about his use of racial slurs. Like I said, I've heard this not only from people who were at the Parkway game, but numerous of HS football coaches in the BR area. But I guess all these people are liars too...righttttt....

My son played football at Live Oak. I have never seen the coach get physical or out of control with anyone. My son wasn't the typical football player that played since grade school. He only played football his last 2 years in high school. He had a great experience under this coach and was treated with respect every day. After several seasons of watching the team and the coaches in home games and out of town games, I have never seen this coach act any other way except exemplery. If this principle had the coach unjustly handcuffed and embarressed for no reason then she definately over stepped and should be sued. Good luck coach! Plus they should allow the teams to replay the game under better circumstances!!

Why was he cuffed ? Was the officer in fear of a battery on himself or others ? I can understand if he was placed in the back of a unit ( office policy maybe) The article does not say if he was transported and booked. I think what you had, was an officer following the wishes of a civilian and not using good policing.

HEARSAY. There are ZERO facts in your comments, mzlouweezyana. No prior reports by anyone official from Parkway, no unsportsmanlike flags thrown, nothing. Just your attempt to paint a picture of something that did not happen and spread rumors about a person you do not know - all the while being very defensive. The more you comment, the sillier you look to those that know this family. To ordell5267, the question is why? Why couldn't they warm-up if their band didn't want to play? Nothing else was happening until the Parkway band was scheduled to play @ 6:45. I saw her interview. She made a huge deal about the itinerary and it seems that she is the one that didn't want to follow it. It was well before 6:45 when she had him removed. If this is not handled properly by the LHSAA, coaches everywhere will be subjected to spur of the moment changes by principals which will apparently make you a law breaker. Officials not needed. Maybe next, players can go to jail for late hits.

But for the record, since comprehension is at a minimum, I never called this man ANYTHING...I said I heard from multiple sources. As far as influence anyone yeah that's what I'm gonna do...clearly cause I know my parents did not name me mzlouweezyana75. And if I didn't live in BR, I would still read the BR paper because I would like to know what's going on in BR and the surrounding areas.

I worked with Coach Musemeche a few years. Not as a coach, but taught near him in the same school. Honestly, this guy is no racist. Stupid accusation(s). A very decent man.

It really is impossible to correctly judge the principal or the coach based upon this article, because we only read the account given by the coach, but my original position still stands: "The principal is the official in charge, and her authority trumps everyone else with the exception of the officials in the game." It does seem, however, that she jumped the gun with the handcuffs. There is a thing called professional courtesy.

Atchaf...kid: Try rereading the article again. This DID occur before the game. The reason LOHS Band was to perform before the game was because the Parkway principal refused to let LOHS band play at halftime. Think about it...Tut was arrested for being on the field during the time Live Oak band was to perform.

I do want to put out there that is very suspect that the person commenting with such negativity towards Coach Musemeche is just a random mom of a random girl with no "dog in the fight" from Parkway. Why would such a random person be on the Baton Rouge newspaper's website? This person called him everything but the kitchen sink and used all the correct buzz words that someone would use if they were trying to influence someone (LHSAA) and incite negative public opinion. Makes you want to say "hmmmmm".

@joey.esposito: I am sorry if it appears that I was labeling THIS coach is out-of-control. What I meant, and perhaps did a poor job of communicating, was that there are many times coaches do get out-of-control and must be removed from a game. Guess who has to be sure that a coach actually leaves a game when he or she is removed by the officials? You guessed correctly! The principal!

@LawyerDan65: I must assume from your name that you are an attorney, however, I also know that school law is not a required course in law school, and many attorneys do not know school law. My post was not a "theory" but school law and LHSAA policy. Since the original article mentions a band performance, we must assume that we are talking about the "half-time show", since bands do not usually perform on the field before a game. The officials generally ask whether the half will be 15 or 20 minutes. Other than that, the officials do not have any control of half-time activities. In most cases, principals communicate before a game about whether bands, dance teams, etc. will be performing at the half. It is generally timed to the minute so that teams can get back on the field for warmup.

First of all, I don't have "a principal". Second of all, I don't think the young men playing football nor all the people working the game who heard the players and the coaching staff say racial slurs are all liars. As for the situation, surely things were emotional on BOTH sides. Regardless, who is right or wrong, the fact that this happened at a HIGH SCHOOL football game between two individuals that are considered role models is deplorable. Now I do understand your hesitancy to believe that the coach, his staff and his players were calling the opposing teams players and fans the N-word...To be honest, I prefer knowing how people feel about me...but it ain't for everybody. Sweetie, if you know anything about judgement, I never made any judgement on anyone, I stated what I heard...that's not judgement. Now because I don't agree with your opinion of your coach...that's another story...but it still doesn't mean I am judging you or him. But at the end of the day, your judgement of me means absolutely nothing for a couple of reasons...one I don't know you and you don't know me...and two, you don't have a heaven or a hell to put me in...so ehhh...have a nice day!!

She went on and on about not agreeing to the schedule and not getting his team off the field - period, end of what she claims happened. Face it, your kids got all worked up and made up stuff like all emotional teenagers do. And why can't I judge you? YOU are judging this man and you don't know him. You weren't even there. So you are telling me that my daughter along with a whole football team and people on the sideline who HEARD the team, coaching staff, including the head coach and fans hurl racial epitaphs are lying. This is something that is well-known among the coaching community in this area. Just because someone is a CHRISTIAN does not mean they are without sin. A person can be nice and prejudiced. Well I am glad that you feel you can judge me or tell me what GOD is going to punish me for, when clearly you don't me or my beliefs. They are some of the nicest CHRISTIAN people you will meet. Plus, you are completely wrong. Before you are quick to support this coach...know that his account is very different from the one my daughter (who attends Parkway) told me. Allegedly he tried to strike the principal of Parkway who is female. I'm also told that he, the coaching staff and the players were very disrespectful to the players and fans of Parkway specifically that they are a bunch of N____. I have also heard that this coach is very racist when he comes to those that are not White and/or male.

I will be forever grateful to have attended a high school where athletics existed, but always played third fiddle to academics and the arts. Before bemoaning the character of today's youth, let's look at the examples provided not by actors, professional athletes, or rappers, but by the very people that WE have specifically put in place to lead by example.

@AtchafalayaKid: I prefaced my comment regarding the accuracy of Tut's version of the incident with "if." Don't be so quick to label a coach as "out-of-control" when, according to his version of the incident, he had obtained the approval of the officials before hand to use the pre-game time allotted to the Live Oak band for his football team to warm-up. This is within LHSAA regulations. Hopefully the LHSAA sportsmanship hearing will bring a reasonable resolution to an unfortunate situation and the lawsuit will be withdrawn.

Actually, once there was an agreement with regard to the warm-up time, Art. 14 of the LHSSA controls. Under your theory a principal could make th opposing team reamin off of the school property until time for kickoff. This was not a riot or any other extrraordinary circumstance, it was just a principal making a horrible decision.

@joey esposito Unless you have been in charge of large crowds of emotional people, including out-of-control coaches, don't be so quick to judge principals. There are good and bad principals, just as in all other professions, but the principalship is one of the most stressful and difficult jobs that exists in this country. Some blowhards would not last one day because you would have slapped a kid, or beat a parent who gave you a good cussing because you had the temerity to discipline her kid. You are making your judgment based upon text taken from the lawsuit. You can believe the attorney wrote it to cast her client in the best light. For some reason I suspect this article doesn't tell the entire story.

This coach will lose this lawsuit. A principal is in total control of everything at a sporting event with the exception of the game itself, which is controlled by the officials. If the officials have an issue with a fan, the PRINCIPAL is charged with removing the offender from the game. The coach should have followed the principal's directive to leave the field when told to do so. I am sure that supporters of the coach, and parents from Live Oak High School--it is a great school--will continue to respond in support of the coach, but he was disobeying a direct order of the official in charge and she was within her rights to have him removed. His disobeying a direct order from the principal in the front of his students was also setting a bad example for his players.

If Tut's version of the incident is indeed accurate, I hope Ms. Craft is successful in the lawsuit. However, we have seen principals and their subordinates are prone to commit perjury a la the Glen Oaks High School head coach who was terminated.
