Fetus cremated without autopsy

The fetus cut from a woman’s womb during an attack on the mother this week was cremated accidentally prior to a scheduled autopsy, authorities said Friday afternoon.

That voids the possibility of upgrading the feticide count to one of murder, District Attorney Scott Perrilloux said Friday evening. Previously, Perrilloux had said that if evidence showed that the fetus had begun to breathe before it was killed, that the feticide count might be upgraded to murder.

However, Perrilloux said he believes the current counts against the suspect in the case can still be prosecuted.

Jeffery Reynolds, 31, 30259 Milton Road, Walker, was booked Tuesday on counts of first-degree feticide and the attempted second-degree murder of his 28-year-old wife, who remained in critical but stable condition Friday.

Authorities allege Reynolds cut open his wife’s abdomen and pulled the fetus from her womb in their home on Milton Road.

“The child was found on scene deceased with a large laceration on top of the child’s skull,” according to a detective’s affidavit attached to the warrant for the arrest of Reynolds on the first-degree feticide count.

Dr. Ron Coe, the Livingston Parish coroner, said Friday afternoon that a funeral home employee accidentally cremated the fetus.

“Livingston Parish government does not maintain a morgue” and has always had to rely on a private funeral home, Coe said.

“Without our knowledge or authorization, a funeral home employee mistakenly removed and cremated the Reynolds fetus prior to autopsy,” the coroner said.

State Police and the Livingston Parish Sheriff’s Office are “investigating the details of the cremation,” and the district attorney was notified, he said.

“The family has been informed and has requested privacy,” Coe said.

The warrant for Reynolds’ arrest alleges he attacked his wife, who was 71/2 months pregnant, with a kitchen knife inside their home.

During the attack, Reynolds cut her “across her throat and abdomen and removed their unborn child,” the affidavit by sheriff’s Detective Jeff Beatty states.

Officials said Reynolds called 911 and that the sounds of his wife screaming in the background can be heard on the tape.

When officers arrived on the scene, they found the suspect kneeling over the victim, the affidavit for his arrest states.

After authorities struggled with and subdued Reynolds, he was taken to a hospital where he was tested for drugs, Sheriff Jason Ard said.

Ard has asked for an expedited determination of whether there were any drugs in Reynolds’ system, said Lori Steele, a spokeswoman for the Sheriff’s Office.

The cremation does not change the counts against Reynolds, who remained in the Livingston Parish Detention Center under a $500,000 bond late Friday, Steele said.

Reynolds has no prior criminal history, Steele said.

Steele said Reynolds has only a traffic citation on his record, and the Sheriff’s Office has found no evidence that deputies ever went to the Reynolds residence on any previous domestic disturbance.

The maximum penalty on a first-degree feticide conviction is 15 years in prison and the maximum penalty for an attempted second-degree murder conviction is 50 years, Steele said.

I have to agree with CBCS that the Sheriff's Office should investigate any ties between the suspect & the funeral home employee. It's hard to believe that the person would cremate without authorization. Hopefully this lunatic will never get out of wherever he is sent!

Yes, which funeral home needs to be sued so the mother can have a comfortable life and get counseling for herself and her other child? Pour the tea now! They need to lose their license. Owned by a Republican politician perhaps?

Why doesn't Livingston Parish have a morgue? I mean how backward and cheap can you get? Could it be because it is run by, oh I don't know..... Republicans? After all conservatives have shown time and again that they only care about people BEFORE they are born. And apparently this one not even then. Could they not have transferred the fetus to EBR and let them do the autopsy or at least keep it until Livingston's coroner could come by and do it? And about that cremation. Livingston Parish needs to be held financially responsible for increasing the pain and suffering of the mother. Was she asked if she wanted an open casket funeral and burial for her prematurely born child? A lot of 7 month fetuses survive and do just fine after a few weeks of intensive care.

How do you accidentally cremate a body? This is your job, your business. You are an expert in this field. Something doesn't pass the smell test. The body happened to be burned the day after you read that if an autopsy shows the baby had any kind of breathing he would be charged with murder. A 7 1/2 mo fetus is no longer a fetus, that's a baby that could easily lived.

The difference between bonds is amazing and both are in LP and what he did is horrific but to say go ahead and charge him if it's scientifically possible isn't how we charge people. We decide trials if there is reasonable doubt but we don't charge people because something is probable. I'm not saying I don't want to see this guy put away for the rest of his life - the 34 year old man who murdered my 16 year old son only served 10 years of a life sentence so I KNOW the feeling of losing a child and sadly, because of this mistake, the max sentence this guy will get isn't enough because the baby never had a chance. We just can't become a society that charges people based on "What if..."

mistakes happen. only the intentional need to be punished, everything else corrected. perhaps tagging the body as sheriff dept would have stopped the employee's mistake. i'm sure there was no evil intent here. they have murder trials all the time without even a body. if they suspect the baby was breathing, why? if scientifically possible and reasonable believeable, charge him with murder.

nothing surprises or shocks me these days...the fetus(7 1/2 mo. old baby) is cremated! others are thrown into garbage cans, flush down toilets, etc..it's sad what's happening to this country of ours...no morals, no respect for life, hate....God help us!

of all the mistakes to make.....what a big one. This guy isn't going to see freedom anytime soon anyway but these sort of mistakes simply can't be made. Apparently they CAN be made. They SHOULDN'T be made. Hopefully LPCO doesn't pay them for this case. The least that that the funeral home can do is not put this on the bill. They have already "helped" enough.
